Oklahoma Declares Sovereignty!

[Full Text of Resolution 1089]

Yesterday Oklahoma’s state representatives passed Resolution 1089 which claims the state’s sovereignty under the Tenth Amendment.

The Tenth Amendment reads

“The powers not delegated to the United States by the
Constitution, nor prohibited by it to the States, are reserved to
the States respectively, or to the people.”
-Tenth Amendment of the Constitution of the United States of America

Resolution 1089 correctly asserts that

“…the Tenth Amendment defines the total scope of federal
power as being that specifically granted by the Constitution of the
United States and no more…

…many federal mandates are directly in violation of the
Tenth Amendment to the Constitution of the United States…

…that Congress may not
simply commandeer the legislative and regulatory processes of the
states…

All of which is absolutely true. Simply stating that is a great first step towards liberty but Oklahoma didn’t stop there. The Resolution further reads…

“Now, therefore, be it resoluved by the House of Representatives
and the Senate of the 2nd Session of the 51st Oklahoma State Legislature:
That the State of Oklahoma hereby claims sovereignty under the
Tenth Amendment to the Constitution of the United States over all
powers not otherwise enumerated and granted to the federal
government by the Constitution of the United States.
That this serve as Notice and Demand to the federal government,
as our agent, to cease and desist, effective immediately, mandates
that are beyond the scope of these constitutionally delegated
powers.”

Congratulations Oklahoma!

Now, this isn’t actually a law. All it does is let the federal government know of their intentions to stop cooperating with unconstitutional federal laws. We’ll see if they actually live up to their promise.

But Resolution 1089 is enough to earn the very first Golden Birdie award from me!

The Golden Birdie Award is awarded only to people or organizations who are brave enough to give the federal government the proverbial golden middle finger they deserve; not just in words but in their actions. Well done Oklahoma!

Montana is currently being considered for the Golden Birdie but first we’ll have to wait and see if they’ll follow through with their threats to secede from the union if DC. v. Heller goes poorly.

  6. See here’s the thing… not only does it really not have teeth as a mere “resolution”, but… it only made it through the HOUSE in Oklahoma. It got stuck in committee in the state senate, so “Oklahoma” never passed it. The session ended at the end of May, so presumably it all has to be started all over again when they start up next year.

  7. Here’s the thing….Doesn’t the very first sentence of the post say that the representatives passed the bill? I didn’t say the governor signed it.

    And didn’t I explain that it effectively does nothing since it isn’t really a law?

  8. It’s IS a step in the right direction. If we are going to preserve our freedoms through next decade we can only do so by untangling ourselves as states from the Federal government. If we continue serving it and it not serving the people the US will go from superpower to 3rd world nation in no time, and taking everyone under it’s unconstitutional thumb down with it.
    The functions of the Federal government outlined by the Constitution as an Agent of the States within the bounds thereof is a good thing…
    What we have today is NOT a good thing.

  10. I haven’t heard anything but since the supreme court (sort of) ruled that the right to keep and bear arms is an individual right, I assume Montana isn’t going to attempt to secede. Maybe we should start a letter writing campaign to the Montana Reps that threatened to secede explaining to them that the Supreme Court decision really is a bad one that infringes upon our rights.

    Citizens to Assemble in Support of Bipartisan Legislative Efforts to Protect Oklahomans from the Federal Collection, Sharing and Control of Personal Data.
    Oklahoma City, OK – A non-partisan “Citizens Assembly for Oklahoma Sovereignty” will be held on Saturday, January 3rd, 2009 in support of upcoming legislation that will protect Oklahomans privacy and prevent the further collection and sharing of sensitive personal data.
    Sponsored by the national group The Constitutional Alliance, OK-SAFE, and R3publicans, the evening meeting will feature special guest speakers Senator Constance Johnson and Representative Charles Key.
    The discussion topics will include Oklahoma’s Tenth Amendment Resolution, which asserts and protects state’s rights; the collection of sensitive personal data, including biometric samples and data; and the global sharing of citizen’s personal information.
    Also discussed will be the federal legislation known as the REAL ID Act of 2005, which, for the first time in our country’s history, standardized the requirements for state driver’s licenses and identification cards. The controversial, and unfunded, federal law included requirements to collect personal biometric data on citizens, participation in a growing national/international database of personal data, and allowed for the global information sharing of data.
    States which were non-compliant with the federal REAL ID mandates were threatened with prohibiting those citizens without the new biometric driver’s licenses or identification cards access to government buildings or being allowed to board a federally regulated airplane.
    Oklahomans overwhelmingly rejected participation in the REAL ID Act of 2005 with the passage of SB 464 in 2007, passed by both houses.
    The bill, signed into law in May 2007 by Democrat Governor Brad Henry, clearly stated Oklahoma’s non-participation in the REAL ID Act, however, in early 2008 the Governor wrote a letter to Department of Homeland Security Secretary Michael Chertoff asking for an extension to comply with REAL ID mandates.
    The Constitutional Alliance has been helping legislators, officials and citizens groups across the country to understand the inherent dangers of biometric data collection and has helped to develop model legislation strengthening a citizen’s right to privacy and identity protection. The Alliance and other conservative groups recognize that Oklahoma, considered the most conservative state in the union, will be looked to as a leader in protecting the rights and freedoms of its’ citizens.
    Nationally known biometric expert, Mark Lerner, who has travelled the U.S. extensively educating legislators and citizens’ groups on the dangers of biometric data collection, will be present. Donations will be accepted to help fund travel expenses for Mr. Lerner.
    The “Citizens Assembly for Oklahoma Sovereignty” will be held at the Character First Training Center, 520 W. Main, Oklahoma City on Saturday, January 3rd, 2009. The meeting begins at 7:00 pm.

  12. Republicans are selfish people, and none to smart. Their simpleton emphasis on the flag, God, and the Country is unbelievable.

    Bush and Cheney lived above the law and gave civil liberties the finger, they refused to answer to the people regarding what really happened on 9/11, spilled innocent American blood in Iraq for nothing (no weapons of Mass Destruction), lied our way into the war, bankrupted our country through unregulated support of business and the wealthy…they are a bunch of crooks but that’s okay with the Republicans, because they are Republican crooks?

    I’ve never seen anyone so sick in their minds as Republicons are now!

  13. Not sure what that has to do with anything. Your simple emphasis on hating one party over the other is unbelievable. Of course what you said is true but it’s equally true of all politicians on both sides of the isle. They’re all scumbags. Most people understand that except when it comes to THEIR pet politicians. People need to realize that all of them are liars, authoritarians, opportunists, and scumbags.

  14. Does anyone remember the Civil War & the outcome? Rather the war of Northern Aggression. (The war was not civil, nor was it a war aginst states, it was a aggression against states that wanted sovereignty under the Tenth Amendment.
